  Offering Investment Advice  
  Questions have been asked about this email blast and the reason for it.

As a reminder, no producer is eligible to offer investment advice unless he/she is licensed as a variable contract producer. Producers should note that the recommendation to replace securities such as mutual funds, stocks, bonds, variable insurance products and various other investment vehicles defined as securities is considered the offering of investment advice. If Assurity has knowledge that a variable contract is being replaced by an Assurity product and the producer is not licensed as a variable contract producer, the application and funds will not be accepted.

Recently we have become aware of several states having regulations in place that specifically state an agent with an insurance license only cannot provide recommendations to replace security type products. Two of the state regulations are attached. In addition, when someone obtains an insurance license, they are advised that they cannot offer advice or make recommendations about securities products. If they want to do that, they would need to obtain a Series 6, 8, etc. license.

  AR Producers Update  
  The Arkansas Department of Insurance has issued the following information regarding token gifts to prospects and clients.

· The [insurance] company and its agents are prohibited from giving any gift as an inducement to a prospective insured to make an inquiry about purchasing, or a current insured renewing, an insurance policy.

· Token gifts of $25.00 or less wholesale value such as ballpoint pens, calendars, notebooks and other items intended for advertising purposes are permitted.

  IL Licensed Producers  
  Effective immediately, producers licensed in Illinois who sell insurance or annuity policies to senior markets are prohibited from using senior-specific certifications, designations and credentials that imply that the producer has special certification or training in advising or servicing seniors or retirees in connection with the solicitation, sale or purchase of a life insurance or annuity product.

The following practices are also specifically prohibited:

· The use of a certification or professional designation by a producer that was not actually earned; or

· The use of a certification or professional designation by a producer that the producer is not eligible to use; or

· Using a nonexistent or self-conferred certification or professional designation; or

· Using a certification or professional designation that states or implies a level of qualification obtained through education, training or experience that the producer does not have; or

· The use of a certification or professional designation that was obtained from an organization that is primarily engaged in the business of instruction in sales or marketing or does not monitor and discipline designation holders for improper or unethical conduct.

A certification or designation from an organization is considered valid if it does not primarily apply to sales or marketing and the certification or designation has been accredited by the American National Standards Institute, the National Commission for Certifying Agencies or any organization recognized as an accrediting agency by the U.S. Department of Education.

  New Software for Legacy Maximizer Producers:

New software is available for download. This will allow you to create quotes for Legacy Maximizer products via your desktop. No internet connection is necessary.

To start, login to the Legacy Insurance Services website and print the Setup: Windows 7 or Setup: Windows XP instructions.

  PA Use of Professional Designations  
  PA licensed producers: The Pennsylvania Insurance Department cautions producers selling life insurance or annuities to seniors not to use any professional designations that may be misleading to seniors and to otherwise comply with Pennsylvania law.

Pennsylvania law prohibits certain unfair financial planning practices, such as a producer using a professional designation if the designation is not a formally recognized financial planning or consulting designation and would lead the consumer to believe that the producer is a financial planner, investment adviser, consultant, financial counselor or any other “specialist” engaged in the business of giving financial planning or advice relating to investments, insurance, tax matters or trust and estate matters when in fact that person is engaged only in the sale of life insurance or annuity policies.

  DC Licensed Producers - Effective immediately, producers licensed in the District of Columbia who sell life insurance or annuities to senior markets are prohibited from the use of senior-specific certifications, designations and credentials that imply that the producer has special certification or training in advising or servicing seniors or retirees.

  Louisiana Continuing Ed.  
  LA Continuing Education requirements Effective immediately, producers licensed in Louisiana who sell life insurance, health insurance or long-term care, may only carry 10 hours of excess CE credit from one year to the next. Also, producers selling LTC products must complete a one-time training course and ongoing training every two years. Details of this training have not yet been provided.

  Agents in South Carolina may not use senior-specific certification or professional designation that might imply that the producer has special certification or training in advising or servicing seniors in connection with the solicitation, sale or purchase of an annuity, accident and health, or life insurance product.

Use of one or more words such as “senior,” “retirement,” “elder,” or like words combined with one or more words such as “certified,” “registered,” “chartered,” “advisor,” “specialist,” “consultant,” “planner,” or like words, in the name of the certification or professional designation is likely to violate this regulation. For more information, see the attached copy of the regulation.

All agent-generated sales materials are required to be approved by Assurity’s compliance department before use.

  Attention Idaho producers: Effective immediately, Assurity Life will no longer be able to grant conditional receipt coverage at the time of application. We have changed the conditional receipt to a premium receipt which states no coverage is in force until underwriting is complete.

  New Disclosure Statement  
  Assurity has revised the Legacy Estate Maximizer Disclosure Statement found in each and every application. This revised form has also been inserted into each state’s application found on our website.

Beginning August 2, 2010 (to ensure the client fully understands they are applying for life insurance) this disclosure statement will be read to your client during the PHI (phone interview) process. Therefore, it is extremely important the PHI (phone interview) is completed at the time of sale by calling 888-318-8554. If the interview needs to be ordered from our office (application was received in office but the PHI was not completed at time of sale), the items on this disclosure statement may cause confusion between the client and the interviewer. Please review the disclosure statement thoroughly with your client PRIOR to completing the PHI (phone interview) process.
